Man sentenced for Facebook threats

MUNCIE — A Muncie man has admitted to posting ominous comments about city police officers on Facebook.

Cody Tyler Stamper, 30, of the 1500 block of East Jackson Street, was arrested June 9 on allegations his postings on the online social network represented threats.

Two of the officers he mentioned were Police Chief Steve Stewart and veteran officer Jesse Neal. Stamper wrote that he wanted 30 seconds alone with Stewart with "no cameras."

In Delaware Circuit Court 5 last week, Stamper pleaded guilty to an intimidation charge stemming from the Facebook remarks.

Under the terms of a plea bargain, he also pleaded guilty to maintaining a common nuisance and possession of marijuana. A second count of intimidation and a resisting-law-enforcement charge were dismissed.

Members of the Muncie Police Department's narcotics unit said Stamper fought with officers when they went to his home to apprehend him in June. The Muncie man was also accused of fighting with officers — and spitting on one — during a June 2013 arrest.

At last week's hearing Judge Thomas Cannon Jr.imposed a two-year sentence, which he suspended. Stamper was placed on probation for two years, and ordered to submit to substance abuse and mental health evaluation.

Stamper still faces charges of resisting law enforcement, possession of marijuana and possession of paraphernalia filed against him last November in Muncie City Court.

Since 2009, the Muncie man has been convicted of battery resulting in bodily injury, resisting law enforcement (twice), attempted criminal trespass, driving while intoxicated (twice), possession of marijuana (twice), public intoxication and disorderly conduct.
