Second suspect in shooting spree captured

MUNCIE – The second Muncie teenager charged in a May 6 shooting spree that critically injured a child was captured Monday in the Indianapolis area.

Treyvon Bennett, 19, was taken into custody by U.S. marshals Monday afternoon at a house in the 4600 block of Birmingham Drive, off East 46th Street near Lawrence.

The teenager — charged with two counts each of attempted murder and aggravated battery — was delivered to the Delaware County jail about 4:30 p.m. He was being held without bond pending an initial hearing.

Muncie Police Chief Steve Stewart said marshals apparently knocked on the door of the house, were allowed inside and asked to speak with Bennett. The teenager came downstairs and surrendered without incident.

Authorities allege Bennett and co-defendant D'ante Napoleon Davis, 16, fired gunshots at another teen — who suffered a non-life-threatening wound in his pelvic region — about 8:10 p.m. May 6 near Eighth and Grant streets.

One of the bullets fired that evening struck a 7-year-old boy, playing in a nearby yard, in the hand and abdomen.

Davis — facing the same charges as Bennett — was arrested at a northside apartment complex on May 13. His defense attorney, Mike Quirk, has said he intends to present an alibi defense, and also claims Davis is a victim of mistaken identity.

Marshals reportedly nearly captured Bennett on May 20 in Brookville, Ohio — about 70 miles southeast of Muncie — but he managed to avoid being arrested that day.
